1. Legal relations between the ordering party and the carrier are governed by the CMR Convention and, in matters not covered by this Convention, by Czech law in the alternative.
2. The carrier is obliged to have valid road carrier's/shipper's liability insurance corresponding to the scope of the compensation obligation under the CMR Convention. The insurance cover must also cover the disappearance of the consignment or part thereof. The carrier is obliged to provide a technically fit vehicle for loading which is also capable of safely transporting the consignment.
4. The carrier shall carefully select competent driving staff and instruct the driver in road transport working procedures and the carrier's liability.
5. The driver shall be present at the loading and carry out a record check of the apparent condition of the consignment and its packaging, as well as the accuracy of the information in the CMR consignment note on the numerical condition of the consignment and its marking within the meaning of Article 8 of the CMR Convention. If the driver is not allowed to load, he shall immediately inform his dispatcher, request his disposition and make a note of this fact in the CMR consignment note.
6. The Carrier is obliged to warn the Sender in writing of any recognizable defect in the packaging/packaging upon acceptance of the consignment for carriage and of any obvious incorrectness of the information given in the CMR-loading note, as well as of obvious circumstances during loading that could cause damage to the cargo being transported. In the event that a defect in the packing or stowage of the consignment on the vehicle is apparent to the driver in the course of a record check such that there is an obvious risk of damage to the consignment, the driver shall be obliged to request the consignor to remedy the defect and, if the consignor does not comply, shall not commence carriage.
7 . When the vehicle is parked in the course of carriage, the driver is obliged to choose a place to park and secure the vehicle with the cargo in such a way as to meet the carrier's obligations to avert a damage event, as agreed in the insurance protection under the carrier's liability insurance.
8. The driver is obliged to immediately report any malfunctions in the course of transport, endangerment of the consignment, delays in transport, damage events or obstacles to the completion of transport and delivery of the consignment to his dispatcher, who is obliged to inform the ordering party and request his instructions.
9. The retention fee is not an entitlement component.
10. The carrier cannot claim from EGT Express CZ s.r.o. compensation for the costs incurred by the unsuccessful arrival.
11. Penalties for withdrawal from the contract of carriage cannot be claimed.
